90minutes ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

Our Position on Content

90minutes is a streaming aggregator and linking service. We do not host, upload, store, or transmit any audio, video, or multimedia content on our servers. All streams accessible through our platform are provided by and hosted on third-party servers that are not owned, operated, or controlled by 90minutes. We merely provide an organized directory of links to content hosted elsewhere on the internet.

Safe Harbor

As a service provider under the DMCA, 90minutes qualifies for safe harbor protection under 17 U.S.C. § 512. We do not have actual knowledge of infringing material on third-party sites, nor are we aware of facts or circumstances from which infringing activity is apparent. We do not receive a financial benefit directly attributable to infringing activity. Upon receiving a valid DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing link(s).

Filing a DMCA Takedown Notice

If you are a copyright owner, or an agent authorized to act on behalf of a copyright owner, and you believe that content linked through our platform infringes your copyright, you may submit a DMCA takedown notice by providing the following information in writing:

1. Identification of the copyrighted work — A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notice, a representative list of such works.
2. Identification of the infringing material — The specific URL(s) on 90minutes.xyz where the allegedly infringing material or link is located. You must provide enough detail for us to locate the material.
3. Your contact information — Your full legal name, mailing address, telephone number, and email address.
4. Statement of good faith — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. Statement of accuracy — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
6. Signature — A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with us. A valid counter-notification must include:

1. Your full legal name, address, telephone number, and email address.
2. Identification of the material that was removed or disabled and the URL where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
4. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located and that you will accept service of process from the person who provided the original DMCA notification.
5. Your physical or electronic signature.

Repeat Infringers

In accordance with the DMCA, we will terminate access to our platform for users or third-party providers who are determined to be repeat infringers in appropriate circumstances.
